Please read this page before relying on anything published on this website. It explains what this website is, what it is not, and the basis on which we deal with purchasers.

1. WHO WE ARE

1.1 SQONEPROPERTYPARTNERS LTD, a company incorporated and validly existing in the Republic of Cyprus with Registration no. HE 444631 and having its registered office situated at 16 June 1943, 7, 3022 Limassol, Cyprus. VAT registration number 60000014V.

1.2 “Square One” is the trading name used on this website for the Company and for the group of companies it heads. Individual developments are owned and sold by separate companies within the group. The company selling any particular property is named in the contract of sale for that property and will not always be SQONEPROPERTYPARTNERS LTD.

2. WHAT THIS WEBSITE IS

2.1 This website is published for information and marketing. It describes developments, properties and services offered by the Square One group.

2.2 Nothing on this website is an offer, an invitation to treat, a representation or a warranty, and nothing on it forms part of any contract.

2.3 No contract for the sale of any property comes into existence until a written contract of sale has been signed by the purchaser and by the selling company. A reservation, an enquiry, an email exchange, a brochure or a conversation with a member of staff or an agent does not create one.

2.4 Where anything on this website differs from the signed contract of sale, the contract of sale prevails.

3. IMAGES, PLANS, SPECIFICATIONS AND AREAS

3.1 Computer generated images, renders, photographs, films, models and show units are illustrative only. They may show landscaping, furniture, fittings, finishes, appliances and decorative items that are not included in the sale.

3.2 Views shown are those available at the time the image was produced. They may change because of development on land we do not own and do not control, and they are not guaranteed.

3.3 Floor plans and site plans are indicative, are not to scale unless expressly stated, and are subject to change as the design is developed and as the permits require.

3.4 Areas quoted for marketing purposes are usually the internal covered area together with a share of common areas, known in Cyprus practice as “domisimo”. The “domisimo” is not the same thing as the share registered against the title at the Land Registry, and neither of them is the same as the value used for tax purposes. The areas, shares and boundaries that govern are those in the contract of sale, in the approved plans and on the title deed.

3.5 Final as built areas may differ from the areas shown on this website. The contract of sale sets out the tolerance that applies and what happens if it is exceeded.

3.6 Specifications may be changed where a material or item is unavailable, or where a change is required by a competent authority or on technical grounds, in which case it is substituted with an item of equivalent or better quality, in accordance with the contract of sale.

4. PRICES, AVAILABILITY, VAT AND COSTS

4.1 Prices are indicative, are subject to change and to withdrawal at any time without notice, and availability is not guaranteed. A price shown on this website is not an offer to sell at that price.

4.2 Unless expressly stated otherwise, prices exclude VAT, Land Registry transfer fees, legal fees, immovable property related municipal and sewerage charges, utility connection and deposit costs, common expenses, furniture packages and any financing cost.

4.3 The VAT treatment of a property depends on the property itself, on the circumstances of the purchaser, on when the supply takes place and on the law in force at that time. The reduced rate for a primary residence applies only where the statutory conditions are met, and eligibility is determined by the Tax Department, not by us. Nothing on this website is a representation that a particular VAT rate, exemption, refund or relief will be available to you.

4.4 Any figure given for rental income, occupancy, service charges, management fees or running costs is an estimate and is not guaranteed.

5. PERMITS, CONSTRUCTION AND TITLE

5.1 Developments shown on this website are at different stages. Some are at concept stage, some have permit applications pending, some are permitted, some are under construction and some are complete.

5.2 The appearance of a development or a unit on this website is not a representation that a planning permit, a building permit, a division permit or a certificate of final approval has been issued for it, or that any of them will be issued, or that any permit remains valid.

5.3 Delivery dates, completion dates and construction programmes shown on this website are estimates. They depend on the issue of permits, on the acts of competent authorities, on utility connections, on weather and on the supply of materials and labour. The only dates that bind anyone are the dates in the signed contract of sale.

5.4 Separate title deeds for individual units are issued by the Department of Lands and Surveys after the certificate of final approval has been obtained and the relevant procedures completed. The timing of that process sits with the competent authorities and is not within our control. Nothing on this website is a representation about when a separate title deed will issue.

5.5 The permit position, the permit validity and the construction status of a specific unit are given on request and are set out in the contract of sale for that unit.

6. NO INVESTMENT, TAX OR LEGAL ADVICE

6.1 Nothing on this website is investment advice, tax advice, legal advice or a personal recommendation, and nothing on it takes account of your circumstances, objectives or needs.

6.2 We make no representation that any property will produce rental income, that any level of yield or occupancy will be achieved, that a property can be resold, that it can be resold within any period, or that it will increase in value. Property values and rents fall as well as rise.

6.3 Where figures for past sales, past prices or past rental performance are shown, they describe the past. They are not a guide to what will happen.

6.4 Statements about the future, including statements about completion, future phases, future amenities, market conditions or returns, reflect our view and the information available at the time they were made. They are not promises, and we are under no obligation to update them.

6.5 If you are purchasing in a currency other than the euro, movements in exchange rates will change what the property costs you and what you receive on a sale. The availability and cost of financing may also change.

6.6 Take your own independent legal, tax and financial advice, from advisers of your own choosing who are not connected with us, before you reserve a property, sign anything or transfer any money.

7. RESIDENCY, IMMIGRATION AND CITIZENSHIP

7.1 We make no representation that the purchase of any property will result in a residence permit, a visa, naturalisation, citizenship or any other immigration outcome, for you or for anyone else.

7.2 Those matters are decided by the authorities of the Republic of Cyprus under criteria that are set by the State and that change. Any information on this website about residence or immigration is general, is not advice, and must not be relied on. Take specialist advice before you buy for that purpose.

8. IDENTITY CHECKS, SOURCE OF FUNDS, SANCTIONS AND PAYMENTS

8.1 Before a reservation is accepted and before a contract of sale is signed, we and the selling company carry out identification and verification checks on the purchaser and on any beneficial owner behind the purchaser, and make enquiries into the source of the funds and, where appropriate, the source of wealth.

8.2 We screen purchasers and their beneficial owners against sanctions lists, politically exposed person lists and adverse media.

8.3 We may ask for documents and information at any stage of a transaction, including after a contract has been signed, and we are required to keep records of what we obtain.

8.4 We may decline to proceed with an enquiry, a reservation or a transaction, or discontinue one, where these checks are not completed to our satisfaction or where proceeding would or might breach applicable law. In some circumstances we are not permitted to tell you the reason.

8.5 Funds must be paid from an account held in the name of the purchaser named in the contract of sale. We do not accept payments from third parties, and we do not accept cash.

8.6 Payment instructions. Our bank account details are given only in the contract of sale or in a document signed on behalf of the selling company. We will never notify a change of bank account by email alone. Before you send any money, telephone the person named in your contract, on the number written in your contract and not on a number given to you in an email or a message, and confirm the account details by voice. If you receive any communication that appears to change our payment details, treat it as fraudulent until you have confirmed it in this way.

9. AGENTS, INTRODUCERS AND THIRD PARTIES

9.1 Agents, brokers and introducers who promote our properties act as independent contractors. They are not our employees or our representatives and they have no authority to make representations on our behalf, to agree terms, to give discounts or to bind any company in the group.

9.2 Anything said or written by an agent that does not appear in the signed contract of sale is not ours and must not be relied on.

9.3 Registration of a client by an agent does not of itself create any entitlement to commission. Commission is governed solely by the written agreement between us and that agent.

10. PERSONAL DATA

10.1 Personal data submitted through this website, or collected during a viewing, a registration, a reservation or a transaction, is processed in accordance with Regulation (EU) 2016/679 and the Cyprus data protection legislation. Our privacy notice explains what we collect, why, on what basis, who we share it with and how long we keep it.

11. INTELLECTUAL PROPERTY

11.1 All content on this website, including text, images, renders, films, plans, logos, names and designs, belongs to us or to our licensors. You may view it and print or download extracts for your own use in considering a purchase. You may not reproduce, republish, distribute or use any of it commercially without our written permission.

12.1 Links to third party websites are given for convenience. We do not control them, we do not endorse them and we accept no responsibility for their content or for anything you do on them.

13. ACCURACY AND LIABILITY

13.1 We take reasonable care over the content of this website, but we do not warrant that it is accurate, complete or up to date. Content may become out of date, and prices, availability, specifications, plans and programmes change.

13.2 To the extent permitted by law, we accept no liability for loss or damage arising from reliance on anything published on this website.

13.3 Nothing on this page excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

13.4 Nothing on this page affects the statutory rights of a purchaser who deals as a consumer.

14.1 We may change this page at any time. The version and date at the top show when it was last changed. The version in force is the one published when you use the website.

15. GOVERNING LAW

15.1 This page and any dispute arising out of it are governed by the laws of the Republic of Cyprus, and the courts of the Republic of Cyprus have jurisdiction. Where you deal as a consumer, this does not deprive you of the protection of any mandatory rule of the law of your country of residence.
